Getting banned on Xbox Live is nothing new. There are sites dedicated to it and if you are banned, you can always play offline. With the new Xbox One however, getting banned results in you losing the “the licenses to any games” associated to your account.
@dohertymark If your account is banned, you also forfeit the licenses to any games that have licenses tied to it as listed in the ToU. ^AC

Microsoft has followed up with a tweet saying that “We have no info on the Xbox One ban situation. The Tweet that is being referenced was a mistake, it was about Xbox 360”. I’m calling bull on that because the original question had nothing to do with the 360 and even if the representative was thinking about the 360, that doesn’t happen when you get banned on the 360.
EDIT: This has been proven false
